The Western Cape High Court dismissed Pluminex (Pty) Ltd’s claim against St Johannis Organisation. The judgment concerns evidence about an alleged service agreement, authority to sign, and whether recommendations were accepted before any binding arrangement arose.

The High Court dealt with an application by the joint business rescue practitioners of De Vos Landgoed (Pty) Ltd to set aside Access Bank’s vote against the company’s business rescue plan under section 153(7) of the Companies Act. Al Mabroor Agri (Pty) Ltd was allowed to intervene, but the strike out application and the main application were dismissed.

The High Court in Pretoria dealt with an application about a claim for compensation under COIDA. The court directed the respondents to make a recommendation in respect of the applicant’s claim within 30 days of the order and ordered costs against the respondents.

The High Court considered an urgent application about whether a magistrate's final spoliation order was suspended by a notice of appeal. It held that the notice of appeal did suspend the order and dismissed the application. The court ordered each party to pay its own costs.

The High Court in Pretoria dealt with an unopposed application for the compulsory winding-up of Garage Propco Holdings (Pty) Ltd. The judgment says the court was satisfied that it had jurisdiction to hear the matter despite Government Notice 7648, and it granted a final winding-up order.

The judgment concerns a divorce between spouses married in community of property, with dispute over division of the joint estate, pension interests, and maintenance for a minor child. The Court granted a divorce and ordered that the plaintiff partially forfeits patrimonial benefits, receiving 25% of the total divisible value of the joint estate after liabilities are settled. The order also places the minor child’s primary residence with the defendant, gives the plaintiff specified contact rights, and directs that maintenance for the child may be taken to a maintenance court.

The High Court in Pretoria North dismissed an application to rescind a default judgment. The judgment says the applicant challenged jurisdiction, alleged defects in the summons and said service was improper, but the court was satisfied that the summons had been personally served at the domicilium address.

The judgment concerns four applications for the voluntary surrender of estates in the Gauteng Division, Pretoria. The court said the applications showed similarities in disclosed assets, creditors and dividends, and refused them. The text also refers to the practice in the Division that a dividend of no less than 20c/Rand is expected in such applications.

The High Court in Pretoria dealt with a commercial court trial in which Standard Bank sought recovery of money lent and advanced under a home loan and suretyship. The judgment records that the defendant appeared in person, that several special pleas were raised, and that the court granted judgment for the bank with interest and costs.

The High Court dealt with an application by the Minister of Police to rescind a default judgment that had awarded R500 000 for unlawful arrest, detention and assault. The court rescinded that award and referred the issue of quantum back to the trial court for proper determination. It also ordered the applicant to pay the costs of the application on an attorney and client scale.

The Supreme Court of Appeal considered an appeal about the South African Board for Sheriffs and the issuing of fidelity fund certificates for acting sheriffs. The judgment records the background to appointments of Mr Seboka and Mr van Wyk, the earlier high court orders, and the mootness issue raised on appeal. The court’s summary states that the appeal concerned the role of the Board in acting sheriff appointments and whether acting sheriffs may perform their responsibilities without a fidelity fund certificate.

The Western Cape High Court dealt with an appeal about a discovery sanction in a lease dispute. The court set aside an order striking out the appellant’s defence and replaced it with an order for further compliance with the rule 23(3) notice. It also set aside punitive costs and substituted party-and-party costs for the application, while ordering the appellant to pay the costs of the appeal.

The judgment concerns a damages claim by Mr Jubase against the Minister of Justice and Correctional Services. The court noted several reasons why the trial could not proceed, including no mediation, non-compliance with Rule 18(10), and an unavailable Magistrate’s Court record.

The Western Cape High Court dealt with an application about a Norfolk pine tree at The Links, Somerset West and a title deed restriction about trees not interfering with the reasonable outlook of other erf owners. The court raised non-joinder on its own and issued a rule nisi so interested residents of the estate can show cause and participate before the matter is finally decided.
