The matter concerned sixteen former SAPS members who joined the Tshwane Metropolitan Police Department and relied on a letter dated 13 January 2021 about accelerated progression to sergeant. The Court dismissed the special plea, but found that the plaintiffs had not proved the written agreement they relied on and dismissed the claim. Each party was ordered to pay its own costs.

The High Court in Pretoria heard an appeal against convictions and sentences arising from a plea and sentence agreement under section 105A of the Criminal Procedure Act. The appellant had pleaded guilty to multiple counts of rape and robbery with aggravating circumstances, and the appeal was refused.

The High Court dealt with an application for leave to appeal and condonation in a dispute between Liberty Coal and Mantengu Mining. The court refused condonation, dismissed the leave application, and ordered costs on scale C. The judgment also refers to earlier findings about the unlawful holding of Liberty information and devices, and to Mantengu's counterapplication and the Anton Piller order.

The Supreme Court of Appeal dealt with an application under section 17(2)(f) of the Superior Courts Act for reconsideration of a refusal of leave to appeal. The matter arose from trade mark opposition proceedings involving FirstRand Limited and National Bank of Abu Dhabi PJSC (Pty) Limited, and the judgment discusses section 10(4) of the Trade Marks Act and the onus in such proceedings.

The Supreme Court of Appeal upheld an appeal by the Mpumalanga Society of Advocates against the Judicial Service Commission’s recommendation of Mr Johannes Hendrikus Roelofse for judicial appointment. It held that the recommendation was unlawful, invalid and unconstitutional, and remitted the matter to the JSC to reconsider his candidature.

The Constitutional Court dealt with a direct appeal and cross appeal arising from orders made against Thabang Motjamela and George Local Municipality. It upheld the appeal and cross appeal in part, set aside the High Court’s mental health assessment orders, and substituted parts of the vexatious litigant order with narrower terms. The Court also directed that its Registrar not accept further applications from Mr Motjamela about the same employment related matters or from applications seeking rescission, direct access or leave to pursue a direct appeal.

The judgment concerns an application for leave to appeal in a matter between an attorney and a former client. The court said the attorney had negligently handled a Road Accident Fund claim on incorrect facts and had under-settled it, and it refused leave to appeal with costs.
