The judgment concerns an application in a Road Accident Fund matter for separation of the claim for general damages from the claim for past medical expenses. The Court refused the requested separation and struck the matter from the roll.

The High Court dealt with a review application about the Gauteng Liquor Board's decision to revoke the applicant's liquor licence. The court found that the licence had lapsed by the time the matter was heard, and dismissed the application as moot.

The Western Cape High Court considered an application in terms of section 424(1) of the Companies Act 61 of 1973 seeking to declare two respondents personally liable for liabilities of four liquidated entities. The court dismissed the application and struck out paragraphs 54 to 58 of the founding affidavit. The judgment also records that the matter involved a prior collapsing order in respect of the entities and a dispute about hearsay material from an enquiry.

The court considered an application to vary a Rule 43 interim order for spousal maintenance and a contribution to legal costs. It held that the spousal maintenance figure should be varied from R50 000.00 to R31 650.00 per month, backdated to 23 January 2026, and that the legal costs contribution should remain unchanged.

The High Court dealt with an execution application and a rescission application brought by a body corporate against two respondents. The court dismissed the rescission application and postponed the execution application sine die under rule 46A(8)(f), with directions for further affidavits and a reconciliation of the amount outstanding.

The High Court considered an application to rescind an earlier order granted in the absence of the applicants. It found that the final notice of enrolment had not been served on the applicants and that the order was erroneously sought and granted under Rule 42(1)(a).

The court gave reasons for an eviction order made on 5 August 2026 in relation to a property in W Park Extension 4, Pretoria. It recorded that the applicant was the registered owner, that the first respondent alleged an oral purchase arrangement and an enrichment lien, and that those claims were not proved on the papers. The judgment also records a later application for leave to appeal, which was dismissed with costs on 18 September 2026.

The High Court in Johannesburg dismissed an interlocutory application by Little Mead No 37 (Pty) Ltd t/a Firstex Engineering Ikapa against Transnet. The application sought to compel compliance with Rule 41A and the Gauteng Division Mediation Protocol in relation to alleged contractual disputes. The court also ordered the applicant to pay the costs of the application.

The Labour Appeal Court dealt with an appeal about a Labour Court order that had reviewed and set aside appointments and employment contracts involving Mr Botsang Moiloa and the CBRTA. It held that the appeal was upheld and replaced the Labour Court order with dismissal of the legality and declaratory applications, with one part of the matter remitted to the Labour Court for determination by another judge.

The Supreme Court of Appeal dealt with a prescription dispute arising from a claim for damages said to follow acupuncture treatment. It considered whether the summons was served on 28 September 2018 and whether that service interrupted prescription, and the appeal was upheld.

The High Court considered an eviction application under PIE concerning a residential property in Witkoppen Extension 3. It found that the earlier dismissal for non-appearance did not bar the fresh application, declared the occupiers unlawful, and ordered vacation by 16 November 2026 with sheriff eviction authorised from 29 November 2026 if they remain.

The Western Cape High Court dealt with an application by Collateral Projects (Pty) Ltd against Clicks Retailers (Pty) Ltd for payment under a trading agreement. The court recorded that the outstanding capital balance was R9 364,44, with mora interest calculated from 25 June 2025, and ordered payment of costs on Scale A.

The High Court in Western Cape Division, Cape Town dismissed an application about a deed of sale for property in Hout Bay. The judgment records that the court found the deed valid ab initio, rejected the applicant’s version about the agreed purchase price, and found the claim for specific performance had prescribed.

The High Court considered an application for condonation for the late filing of a statutory notice under section 3(4)(a) of the Institution of Proceedings against Certain Organs of State Act. It found that no good cause was shown for the late notice and that the damages claim had already prescribed. The application was dismissed with costs on scale B.
